These Terms and Conditions apply to all orders, bookings, mobile tyre fitment services, goods and related services supplied by Driveway Tyres (Pty) Ltd.
In these Terms and Conditions, “Driveway Tyres”, “we”, “us” or “our” refers to Driveway Tyres (Pty) Ltd. “Customer”, “you” or “your” refers to the person placing the order, making a booking, paying for goods or services, or receiving the goods or services.
- Acceptance of Terms
1.1 By placing an order, making a booking, submitting proof of payment, accepting a quotation, or allowing Driveway Tyres to perform any service, you agree to these Terms and Conditions.
1.2 These Terms and Conditions apply together with any quotation, invoice, order confirmation, booking confirmation, payment instruction or written communication issued by Driveway Tyres.
1.3 Nothing in these Terms and Conditions excludes, restricts or limits any right or remedy that a customer may have under applicable law, including the Consumer Protection Act, where such exclusion, restriction or limitation is not permitted by law.
- Services Provided
2.1 Driveway Tyres provides mobile tyre fitment services, including the supply and fitment of tyres and related tyre services where applicable.
2.2 Driveway Tyres does not provide wheel alignment services.
2.3 Any additional services not expressly included in the order, invoice or booking confirmation may be quoted and charged separately.
2.4 Services are provided subject to tyre availability, service area, safe working conditions, weather conditions, payment clearance, correct customer information, and Driveway Tyres’ operational capacity.
- Service Area
3.1 Driveway Tyres operates in selected areas within Gauteng, including Pretoria, Centurion, Midrand and Johannesburg, excluding certain outlying areas.
3.2 Driveway Tyres reserves the right to decline, cancel or reschedule an order or booking where the customer’s location is outside our service area or where the location is not practical, safe or commercially viable for mobile fitment.
3.3 If an order is placed for an area that Driveway Tyres does not service, Driveway Tyres may cancel the order and refund any amount paid, less any reasonable costs already incurred where permitted by law.
- Bookings and Fitment Times
4.1 Standard fitment hours are Monday to Friday, 08h00 to 17h00, excluding public holidays.
4.2 Any booking date or time provided is an estimated appointment window and is subject to confirmation by Driveway Tyres.
4.3 Next-business-day fitment may be offered where possible, but is not guaranteed. It depends on tyre availability, payment clearance, the customer’s location, booking capacity and operational conditions.
4.4 Driveway Tyres will make reasonable efforts to attend to confirmed bookings within the agreed or estimated time. However, traffic, weather, supplier delays, tyre availability, vehicle access issues, incorrect customer information, safety concerns, previous bookings running late or other circumstances may result in delays or rescheduling.
4.5 Driveway Tyres will not be liable for inconvenience, loss of time, loss of income, missed appointments, travel costs, loss of use of the vehicle or any indirect or consequential loss arising from a delay, cancellation or rescheduling, except where liability cannot legally be excluded.
- Customer Information and Responsibilities
5.1 The customer is responsible for providing complete and accurate information when placing an order or making a booking.
5.2 This includes, but is not limited to:
(a) full name and contact details;
(b) fitment address;
(c) vehicle make, model and year;
(d) correct tyre size;
(e) tyre quantity;
(f) any special access instructions;
(g) whether the vehicle has locking wheel nuts;
(h) whether the vehicle is modified, lowered, damaged or fitted with non-standard wheels; and
(i) any other information that may affect the supply or fitment of tyres.
5.3 Driveway Tyres will not be liable for delays, incorrect orders, failed fitments, additional costs or losses caused by incorrect, incomplete or misleading information supplied by the customer.
5.4 The customer must ensure that the vehicle is accessible, safe to work on, parked on a suitable surface, and available at the confirmed fitment time.
5.5 The customer must ensure that there is enough space around the vehicle for Driveway Tyres to work safely.
5.6 Driveway Tyres may refuse to perform or continue work if the location, vehicle, weather, surface, surroundings or circumstances are unsafe or unsuitable.
- Orders and Order Acceptance
6.1 Placing an order, submitting proof of payment or completing an online order form is an offer to purchase goods or services from Driveway Tyres.
6.2 An automated order confirmation or payment confirmation does not automatically mean that Driveway Tyres has accepted the order.
6.3 Driveway Tyres will review the order details and may confirm, decline, amend or cancel the order where necessary.
6.4 Driveway Tyres may decline, amend or cancel an order for reasons including, but not limited to:
(a) incorrect pricing;
(b) incorrect product description;
(c) product unavailability;
(d) supplier stock errors;
(e) incorrect tyre size ordered;
(f) customer location outside the service area;
(g) unsafe or unsuitable fitment conditions;
(h) payment not clearing;
(i) suspected fraud;
(j) website or system errors; or
(k) any other reasonable operational or commercial reason.
6.5 If Driveway Tyres cannot supply the ordered tyres or services, Driveway Tyres may offer an alternative product or appointment. The customer may accept or reject the alternative.
6.6 If the customer rejects the alternative and payment has already been made, Driveway Tyres will refund the customer, subject to these Terms and Conditions and applicable law.
- Product Availability, Pricing and Website Information
7.1 Driveway Tyres makes reasonable efforts to ensure that product information, availability, prices, descriptions and images are accurate.
7.2 However, errors may occur, including incorrect pricing, incorrect descriptions, incorrect stock availability, website errors, supplier errors or product listing errors.
7.3 Driveway Tyres reserves the right to correct any error, amend product information, update pricing, remove products, cancel an order or offer an alternative product where an error has occurred.
7.4 If an order is cancelled due to an error and the customer has already paid, Driveway Tyres will refund the amount paid for the cancelled item or service, subject to any lawful deductions for reasonable costs already incurred.
7.5 Product images are for illustration purposes only and may differ from the actual product supplied.
- Correct Tyre Size and Vehicle Compatibility
8.1 It is the customer’s responsibility to ensure that the correct tyre size and specification is ordered for the vehicle.
8.2 Driveway Tyres may assist with tyre size guidance where possible, but the customer remains responsible for confirming compatibility before placing an order.
8.3 Driveway Tyres may refuse to fit tyres that are incorrect, unsafe, unsuitable, incompatible with the vehicle, or not recommended for the vehicle or wheel.
8.4 If the customer orders incorrect tyres, Driveway Tyres may charge a reasonable handling, administration, supplier return, transport or cancellation fee based on costs already incurred.
8.5 Special-order tyres, uncommon sizes, imported tyres or tyres ordered specifically for the customer may be subject to supplier return rules and may not always be refundable once ordered, except where required by law.
- Payment
9.1 Payment is required before goods are supplied or services are rendered, unless Driveway Tyres agrees otherwise in writing.
9.2 Orders may only be processed once payment has cleared or once Driveway Tyres is satisfied that payment has been properly made.
9.3 Driveway Tyres may use third-party payment providers for online transactions. Payment processing is subject to the terms, conditions and processing times of the relevant payment provider.
9.4 Driveway Tyres is not liable for delays, failed payments, bank charges, payment gateway errors or disputes between the customer and the payment provider, except where such liability cannot legally be excluded.
9.5 All prices are subject to change without prior notice, except where an order has already been accepted by Driveway Tyres in writing.
- Cancellations and Rescheduling by the Customer
10.1 The customer may request to cancel or reschedule a booking by contacting Driveway Tyres by phone, WhatsApp or email.
10.2 The customer should provide at least one business day’s notice before the scheduled appointment where possible.
10.3 If the customer cancels, reschedules late, is unavailable, provides an incorrect address, fails to provide access to the vehicle, or misses a confirmed appointment, Driveway Tyres may charge a reasonable cancellation, call-out, handling, supplier, transport or administration fee based on costs already incurred.
10.4 The amount of any cancellation or no-show fee will depend on the circumstances, including the notice given, the nature of the order, whether tyres were specially ordered, whether Driveway Tyres had already travelled to the customer, whether supplier costs were incurred, and whether the appointment could reasonably be reallocated.
10.5 Driveway Tyres will not charge a cancellation fee where such a fee is not permitted by law.
- Cancellations and Rescheduling by Driveway Tyres
11.1 Driveway Tyres may cancel or reschedule a booking where necessary for operational, safety, weather, stock, payment, location, vehicle access, supplier or other reasonable reasons.
11.2 Where Driveway Tyres needs to cancel or reschedule, Driveway Tyres will make reasonable efforts to notify the customer as soon as possible and to arrange an alternative appointment where practical.
11.3 Driveway Tyres will not be liable for inconvenience, loss of time, loss of income, travel costs, loss of use of the vehicle or any indirect or consequential loss caused by cancellation or rescheduling, except where liability cannot legally be excluded.
- Refunds
12.1 Refund requests must be submitted to Driveway Tyres by email, WhatsApp or another recorded communication channel.
12.2 Approved refunds will be processed using the original payment method where possible, unless another method is agreed or required.
12.3 Refunds may be subject to the processing times of banks, payment gateways, suppliers or other third parties.
12.4 Where goods or services cannot be supplied, Driveway Tyres will refund the customer in accordance with applicable law.
12.5 Driveway Tyres may deduct reasonable costs already incurred where permitted by law. These may include supplier charges, transport costs, handling fees, payment gateway fees, administration costs, cancellation costs or costs for work already performed.
12.6 No refund will be due for services already completed, unless required by law or unless Driveway Tyres agrees otherwise in writing.
12.7 If tyres have already been fitted to the customer’s vehicle, the tyres are considered used and may not be returnable unless there is a valid warranty claim, defect claim or legal basis for return.
- Fitment Conditions
13.1 The customer must ensure that the vehicle is parked in a safe, accessible and suitable location for mobile tyre fitment.
13.2 Driveway Tyres may refuse or stop work where:
(a) the vehicle is parked on an unsafe or unsuitable surface;
(b) the area is unsafe or restricted;
(c) there is not enough working space;
(d) weather conditions make the work unsafe or impractical;
(e) the vehicle is damaged, modified, unstable or unsafe to lift;
(f) the correct locking wheel nut key is not available;
(g) wheel nuts, studs, hubs, rims or related parts are damaged, seized, stripped, missing or unsafe;
(h) the customer is unavailable or cannot provide access; or
(i) Driveway Tyres reasonably believes that continuing work may cause damage, injury or safety risk.
13.3 If Driveway Tyres cannot complete the fitment because of any issue caused by the vehicle, customer, location, missing tools, incorrect information or unsafe working conditions, Driveway Tyres may charge a reasonable call-out, cancellation, handling or administration fee.
- Locking Wheel Nuts, Wheel Nuts, Studs and Related Parts
14.1 The customer must inform Driveway Tyres before the appointment if the vehicle has locking wheel nuts.
14.2 The customer must provide the correct locking wheel nut key at the fitment appointment.
14.3 Driveway Tyres will not be liable for delays, failed fitment, additional costs or damage caused by missing, incorrect, worn, damaged, seized, overtightened or defective locking wheel nuts, locking wheel nut keys, wheel nuts, studs, hubs or related parts.
14.4 Driveway Tyres may refuse to remove locking wheel nuts, wheel nuts or related parts where removal may cause damage or where the parts appear damaged, unsafe, seized, stripped or unsuitable.
14.5 If the customer requests or authorises the removal of damaged, seized, stripped or problematic locking wheel nuts or wheel nuts, the work will be done at the customer’s risk, except where damage is caused by Driveway Tyres’ proven negligence.
14.6 Removal of locking wheel nuts or damaged wheel hardware is not guaranteed.
- Vehicle Condition and Pre-existing Damage
15.1 The customer is responsible for the condition of the vehicle, wheels, tyres, wheel nuts, studs, hubs, suspension, jacking points, locking wheel nut keys, TPMS sensors and related parts before Driveway Tyres begins work.
15.2 Driveway Tyres will not be liable for pre-existing damage, wear and tear, corrosion, poor previous repairs, damaged jacking points, damaged rims, cracked rims, buckled rims, defective TPMS sensors, damaged valve stems, seized parts, stripped threads, overtightened wheel nuts, aftermarket parts, non-standard modifications, or defects that existed before the service.
15.3 Driveway Tyres may take photographs or videos of the vehicle, wheels, tyres, parts or working area before, during or after the service for record, quality, warranty, dispute or insurance purposes.
- Care, Damage and Limitation of Liability
16.1 Driveway Tyres will take reasonable care when working on the customer’s vehicle.
16.2 Driveway Tyres will not be liable for any damage, loss, delay, failed fitment or additional cost caused by:
(a) incorrect, incomplete or misleading information supplied by the customer;
(b) pre-existing damage or defects;
(c) worn, damaged, seized, stripped, overtightened or defective parts;
(d) missing or incorrect locking wheel nut keys;
(e) unsafe or unsuitable fitment locations;
(f) weather or circumstances outside Driveway Tyres’ reasonable control;
(g) customer-supplied tyres or parts;
(h) vehicle modifications or non-standard parts;
(i) supplier or manufacturer defects; or
(j) any cause not directly resulting from Driveway Tyres’ proven negligence.
16.3 Driveway Tyres will not be liable for indirect, special or consequential losses, including loss of income, loss of profit, loss of use of the vehicle, inconvenience, missed appointments, transport costs, accommodation costs, towing costs, recovery costs or third-party claims, except where liability cannot legally be excluded.
16.4 Nothing in these Terms and Conditions excludes liability for gross negligence, wilful misconduct, fraud or any liability that cannot lawfully be excluded.
- Wheel Nut Recheck
17.1 After tyre fitment, the customer is responsible for checking or arranging the checking of the vehicle’s wheel nuts after approximately 80 km of driving.
17.2 This check is recommended to ensure that the wheels have seated correctly and that the wheel nuts remain secure.
17.3 The customer must stop driving and seek assistance immediately if any vibration, noise, looseness, warning light or abnormal driving condition occurs after fitment.
- Tyre Warranty and Defects
18.1 Tyres are subject to the applicable manufacturer’s warranty, supplier warranty and inspection process.
18.2 If a tyre is alleged to be defective, the tyre may need to be returned to the manufacturer or supplier for assessment before a warranty outcome can be confirmed.
18.3 Driveway Tyres does not decide manufacturer warranty outcomes and is not responsible for delays caused by manufacturer or supplier inspection processes.
18.4 If the customer requires an immediate replacement tyre while a warranty inspection is pending, the customer may need to purchase a replacement tyre. If the warranty claim is approved by the manufacturer or supplier, the applicable refund, credit or replacement will be processed in accordance with the warranty outcome.
18.5 Warranty claims may be rejected where damage is caused by punctures, impact damage, potholes, kerb damage, under-inflation, over-inflation, incorrect alignment, suspension faults, misuse, racing, overloading, road hazards, accident damage, vandalism, improper use or any other cause not related to a manufacturing defect.
- Fitment Workmanship
19.1 If the customer believes there is an issue with the fitment work performed by Driveway Tyres, the customer must notify Driveway Tyres as soon as reasonably possible and must stop using the vehicle if continued use may cause damage or create a safety risk.
19.2 Driveway Tyres must be given a reasonable opportunity to inspect the issue before the customer arranges third-party repairs, unless urgent repairs are required for safety reasons.
19.3 If Driveway Tyres confirms that an issue was caused by its workmanship, Driveway Tyres may, at its election, repair the issue, redo the fitment-related work, refund the affected service portion, or offer another reasonable remedy.
19.4 Driveway Tyres will not be liable for fitment issues caused by pre-existing vehicle defects, customer-supplied tyres, customer-supplied parts, incorrect tyre sizes, damaged rims, damaged wheel nuts, damaged studs, damaged hubs, TPMS faults, wheel alignment issues, suspension issues, road hazards or use of the vehicle after a warning sign appears.
- Customer-Supplied Tyres or Parts
20.1 Where Driveway Tyres agrees to fit tyres or parts supplied by the customer, Driveway Tyres is not responsible for the quality, safety, legality, condition, age, specification, suitability or warranty of those tyres or parts.
20.2 Driveway Tyres may refuse to fit customer-supplied tyres or parts that appear unsafe, damaged, incorrect, unsuitable, excessively old or unlawful.
20.3 The customer accepts responsibility for any risk, loss, defect or failure related to customer-supplied tyres or parts, except where caused by Driveway Tyres’ proven negligence during fitment.
- Safety
21.1 The customer must keep children, pets and bystanders away from the working area while Driveway Tyres performs the service.
21.2 The customer must not interfere with Driveway Tyres’ equipment, tools, vehicle, lifting equipment or work area.
21.3 Driveway Tyres may stop work immediately if the customer or any other person creates an unsafe working environment.
- Personal Information
22.1 Driveway Tyres may collect and process personal information provided by the customer, including name, contact details, address, vehicle details, order details and payment-related information.
22.2 Personal information is used for purposes including processing orders, arranging bookings, supplying goods and services, communicating with customers, handling payments, managing warranty claims, keeping business records, resolving disputes and complying with legal obligations.
22.3 Driveway Tyres will take reasonable steps to protect personal information and will not sell customer personal information.
22.4 Driveway Tyres may share personal information with payment providers, suppliers, service providers, insurers, professional advisers, regulators or other parties where necessary to process orders, provide services, resolve disputes, comply with the law or protect Driveway Tyres’ rights.
- Complaints and Disputes
23.1 Any complaint must be submitted to Driveway Tyres as soon as reasonably possible after the issue arises.
23.2 The customer must provide reasonable supporting information, including photographs, videos, invoices, vehicle details, tyre details, location details and a description of the issue where applicable.
23.3 Driveway Tyres must be given a reasonable opportunity to investigate and respond to the complaint.
23.4 The customer must not dispose of, repair, replace or alter any tyre, wheel or part that is the subject of a complaint before Driveway Tyres or the relevant supplier has had a reasonable opportunity to inspect it, unless urgent action is required for safety reasons.
- Force Majeure
24.1 Driveway Tyres will not be liable for failure or delay in performing any obligation where the failure or delay is caused by circumstances beyond its reasonable control.
24.2 This includes, but is not limited to, severe weather, traffic disruptions, accidents, strikes, supplier delays, stock shortages, load shedding, power failures, system failures, payment gateway failures, civil unrest, road closures, crime, safety risks, illness, acts of government, natural disasters or other events outside Driveway Tyres’ reasonable control.
- Changes to Terms and Conditions
25.1 Driveway Tyres may update these Terms and Conditions from time to time.
25.2 The Terms and Conditions that apply to an order are the terms in force at the time the order is placed, unless otherwise required by law or agreed in writing.
- Severability
26.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary.
26.2 The remaining provisions will continue to apply.
- Governing Law
27.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.
27.2 The customer and Driveway Tyres agree that any dispute will be dealt with in South Africa, subject to any rights or forums available to the customer under applicable law.
